The Movement for Quality Government in Israel on the plan to restrict flights leaving Israel: “This is a serious violation of the constitutional right to leave the country”

The Movement for Quality Government in Israel wrote to Prime Minister Netanyahu, the minister of transport, and the legal advisor to the prime minister yesterday, Tuesday 17 June, demanding that a government decision not be made that prohibits airlines from allowing departures from the country.

The Movement warns that such a decision, if taken, will seriously violate the constitutional right of Israeli citizens to leave the country, enshrined in Article 6 of Basic Law: Human Dignity and Liberty, and that it is highly doubtful as to whether such sweeping restrictions can be put into force based solely on a government decision.

In its letter, the Movement refers to the Supreme Court ruling of 17 March 2021, according to which regulations that imposed restrictions on entry and exit from the country are unconstitutional because they do not pass the proportionality test. Judge Hayut then emphasized the paramount importance of the right granted to a citizen to leave and enter his country as “one of the foundations of constitutional life.”

The Movement emphasizes that although the right to movement is not absolute, significant weight must be given to the fact that this is a violation of the freedom of movement and the constitutional right of citizens, and to act as much as possible to achieve a proportionate solution that will balance the purpose of maintaining the security of citizens and the violation of the constitutional right.
