The Movement for Quality Government in Israel’s Response to the Supreme Court Ruling Striking Down the Law Freezing the Arrest of Draft Evaders

“This is an important victory for equality before the law, the rule of law, and all those who shoulder the burden. Today, the Supreme Court affirmed what we argued in our petition: the law cannot create special protections for one sector whose members fail to report for military service while continuing to be enforced against others. The Court ruled unanimously that the legislative process was fundamentally flawed, and a majority of eight justices also found that the law severely infringes upon the core of the constitutional right to equality and fails to meet constitutional requirements.
The Knesset attempted to pass, through a flawed legislative process, a law that deepens inequality and weakens enforcement of the duty to serve, and the Supreme Court struck it down. The same law must apply to everyone. We will continue working to ensure that the duty to serve and its enforcement are applied equally and effectively to all those subject to the draft.
